Ohio-based rockers The Black Keys and New York-born musician and producer Danger Mouse have filed separate lawsuits against The Home Depot and Yum! Brands, the parent company of Pizza Hut, over claims that the companies used their music in a pair of advertisements without proper authorization, Billboard reports.
The suits allege that the companies are guilty of “a brazen and improper effort to capitalize on plaintiffs’ hard-earned success” by using The Black Keys’ music in two ads. The song “Lonely Boy” appears in a commercial for the pizza giant’s Cheesy Bites, while the Atlanta-based home improvement product retailer used the song “Gold On the Ceiling” in an ad for Ryobi power tools. The songs in question are the first two singles from the band’s 2011 album El Camino. Danger Mouse co-wrote and co-produced the album.
The suits claim the band sent letters in May requesting that the companies stop showing the ads.
A spokesman for The Home Depot tells Billboard the company has not seen the complaint but that they “take intellectual property very seriously.”
The plaintiffs have asked for jury trials.
The Black Keys are strenuously protective of their work, having previously refused to make all of their music available on popular music-streaming service Spotify. The band famously called board member Sean Parker an “asshole,” saying the service is unfair to artists and that it’s not a “feasible” way to make a living from their music.
